Patrick Lai practices in the area of intellectual property law with an emphasis on patent prosecution and patent litigation.
Mr. Lai’s patent prosecution experience includes the preparation and prosecution of domestic and international patent applications in a wide range of technologies, including computer software, computer hardware, networking, distributed systems, AR (augmented reality)/VR (virtual reality), artificial intelligence, cloud-computing software-defined storage, and wireless communication technologies. In addition, Mr. Lai has significant experience drafting dozens of patent applications related to AR/VR, wireless communication, and machine learning technologies for major telecommunications and technology companies.
Mr. Lai’s practice also includes a focus on representing and counseling clients in all aspects of patent litigation, including domestic and international patent protection, enforcement, and monetization of patent portfolios. His practice also includes rendering non-infringement, patent validity, and freedom-to-operate opinions of counsel.
Prior to joining LHDK&W, Mr. Lai practiced as a prosecution attorney at two boutique firms dealing with domestic and foreign patent prosecution related to various technical fields of art and as an associate in the intellectual property group of two international law firms, where his practice focused on domestic, international intellectual property disputes, and patent office post-grant proceedings. Mr. Lai also has litigation experience before the United States District Court for the Southern District of California, AIA Inter Partes Review (IPR), and before the International Trade Commission (ITC). Prior to his legal career, Patrick was an engineer in the medical device industry and a program director of a college radio station. While attending law school, Mr. Lai was a commercial legal extern in the Products and Agreements group at a prominent technology company, where he conducted due diligence for acquisitions and performed legal analysis to identify potential intellectual property issues.
Mr. Lai is admitted to practice law in the State of California, the United States District Court for the Southern District of California and is registered to practice before the U.S. Patent and Trademark Office.
